These Terms from a binding legal agreement between you and Sabio Tang and Tushar Sinha (together, the "Operators"), who jointly operate the service. These Terms are governed by the laws of England and Wales, as set out in Section 12, regardless of either Operator's location.

You must be at least 13 years old to use the Service. If you are between the age of 13 and the age of majority in your jurisdiction, you may only use the Service with the consent of, and under the supervision of, a parent or legal guardian, who by permitting your use agrees to these Terms on your behalf.
The Service is available worldwide. Some jurisdictions set a higher minimum age of digital consent than 13, and if the minimum age of digital consent in country of residence is higher than 13, you must have the consent of a parent or legal guardian before using the Service, regardless of the general minimum stated above.
By using this Service, you represent and warrant that:
The Service is not directed at children under 13. We do not knowingly collect personal data from anyone under 13. If you become aware that a child under 13 has provided us with personal data, contact us at legal@literallyjustafilehost.com so we can delete it.
Literally Just A File Host allows registered users to upload, store, and share files. The Service relies on third-party infrastructure to operate, including authentication providers for account sign-in and cloud storage for hosting uploaded files, as described further in Section 7.
The Service is made available worldwide. We do not represent that the Service is appropriate, legal, or available for use in every location, and you are responsible for ensuring your use of the Service complies with the laws applicable to you.
The Service is provided free of charge. We may add, change, remove, or limit any feature, which includes but is not limited to storage capacity, file size limits, bandwidth, and file retention periods at any time and without prior notice. We may also introduce paid tiers or usage limits in the future. If we do, we will make reasonable efforts to notify existing users before any change that affects their existing account.
To use certain features of the Service, you must create an account. You may do this directly or by signing in through a supported third-party provider, such as GitHub, Google, or Hack Club Auth.
You are responsible for:
If you sign in using a third-party provider, your ability to access your account depends on your continued access to that third-party account. We are not responsible if you lose access to your account as a result of losing access to a third-party sign-in provider.
We reserve the right to suspend or terminate accounts that violate these Terms, as described in Section 9.
You agree not to use the Service to store, upload, or distribute any content that:
You further agree not to:
Violation of this Section may result in removal of the offending content, suspension, or permanent termination of your account, as described in Section 6 and 9.
"User Content" means any file, data, or other material you upload, store, or share using the Service.
You retain all ownership rights in your User Content. Nothing in these Terms transfers ownership of your User Content to us.
By uploading User Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, store, reproduce, and trasmit your User Content, solely for the purpose of operating, maintaining, and providing the Service to you. This license ends when you delete the relevant User Content or your account, except to the extent a copy has already been shared with a third party at your direction, or must be retained to comply with law or resolve a dispute.
You are solely responsible for your User Content, and you represent and warrant that:
We do not monitor User Content as a matter of course. We reserve the right, but do not assume any obligation, to review, and to remove or disable access to, any individual file that we believe violates these Terms or applicable law, per Section 5. This may occur independently of any action taken against your account under Section 9.
We do not guarantee the availability, integrity, or persistence of any User Content and recommend you keep independent backups of anything important, as described further in Section 8.
The Service relies on third-party providers to deliver its core functionality. This includes, but is not limited to:
Your use of the Service is also subject to the applicable terms of service, acceptable use policies, and privacy practices of these third-party providers. If your use of the Service violates a third-party provider's own policies, we may be required to suspend or remove the affected content or account, independently of any action we take under Sections 6 and 9.
We do not control, and are not responsible for, the availability, performance, security, or business practices of any third-party provider. If a third-party provider experiences an outage, changes its policies, restricts our access, or discontinues service to us, the Service (or parts of it) may become unavailable, degraded, or permanently discontinued as a result, and we will not be liable for any resulting loss, including loss of access to your User Content.
Where reasonably practicable, we will make efforts to notify users in advance of a material change to the third-party providers the Service relies on. This is not always possible, particularly where the change originates from the third-party provider itself and is outside our control.
The Service is provided free of charge, on an "AS IS" and "AS AVAILABLE" basis, without warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
Without limiting the above:
We may suspend, restrict, or permanently discontinue the Service, or any part of it, at any time and without notice, including as a result of factors outside our control such as the loss of access to a third-party provider described in Section 7.
Nothing in this Section limits any statutory right or protection that applies to you as a consumer and cannot lawfully be excluded or limited by agreement.
We may take action against your account for violating these Terms, or for any other reason at our discretion, at any time and with or without prior notice. Action may include:
Which action we take, and whether we give advance notice, depends on the severity of the violation. Serious violations, including uploading illegal content such as CSAM, as described in Section 5, will result in immediate permanent termination without prior notice.
Deletion of files: if your account is permanently terminated, some or all files associated with your account may be deleted, in addition to any individual file already removed under Section 6. We are not obligated to retain, export, or return your files to you following termination, and recommend keeping independent backups of any important files, as described in Section 8. A temporary suspension does not, by itself, result in file deletion, but files may still become inaccessible for the duration of the suspension.
You may stop using the Service, and may request deletion of your account and associated data, at any time.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination, including Sections 6, 8, 10, 11, and 12, will survive.
To the maximum extent permitted by applicable law, the Operators and their contributors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunity, arising out of or relating to your use of, or inability to use, the Service, whether based in contract, tort, negligence, strict liability, or otherwise, and even if the Operators have been advised of the possibility of such damages.
This includes, without limitation, any loss or damage arising from:
Because the Service is provided free of charge and due to the limited team maintaining this Service, the Operators' total aggregate liability for any and all claims relating to the Service shall not exceed £0, regardless of the number of claims or the theory of liability.
Nothing in this Section excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under consumer protection law applicable to you.
You agree to indemnify, defend, and hold harmless the Operators and their contributors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:
This obligation will survive termination of your account or these Terms, as described in Section 9.
These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes or claims), are governed by, and constructed in accordance with, the laws of England and Wales.
The courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or the Service.
This choice of governing law and jurisdiction applies regardless of where you or the Operators are located, and regardless of the country from which you access the Service.
If you are accessing this Service as a consumer and are resident in a country other than England or Wales, nothing in this Section deprives you of the protection of any mandatory provisions of the law of your country of residence that cannot be excluded by agreement, or affects your right to bring proceedings in the courts of your own country where local consumer protection law entitles you to do so.
We may revise these Terms at any time. If we make a change that we consider material, we will make reasonable efforts to notify existing users before the change takes effect by email.
Non-material changes, such as clarifications, formatting updates, or corrections that do not affect your rights or obligations, may be made without prior notice.
The date at the top of this document reflects when it was last revised. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms. If you do not agree to a revised version of these Terms, you must stop using the Service, and may request deletion of your account and associated data as described in Section 9.
The source code for the Service is available under the GNU Affero General Public License v3.0 license at https://github.com/LiterallyJustAFileHost/repo.
These Terms govern your use of the hosted, publicly available instance of the Service operated by the Operators. They do not alter, restrict, or replace the terms of the open-source license under which the underlying source code is made available. If you obtain, self-host, or modify the source code independently of the Operators' hosted instance, your use of that code is governed solely by the applicable open-source license, and these Terms do not apply to that use.
Nothing in these Terms should be read as limiting any right granted to you under the open-source license, or as imposing additional restrictions on the source code beyond what that license permits.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or removed to the maximum effect necessary, and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision, and does not prevent us from enforcing it later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, at our discretion, including in connection with a change in how the Service is operated.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Operators regarding the Service, and supersede any prior agreements or understandings, whether written or oral, relating to it.
Nothing in these Terms creates a partnership, join venture, employment, or agency relationship between you and the Operators.
Questions about these Terms can be sent to contact@literallyjustafilehost.com.
